Our client suffered lumbar spine injuries after being hit by a negligent driver who ran a stop sign. The client required lumbar spine surgery within weeks of the accident, however, the insurance carrier argued the need for surgery was due to a preexisting condition. We aggressively argued that the insurance company was acting in bad faith and pushed for an immediate settlement of all available policy limits.
Within six months of the accident, we achieved a tender of the both the $25,000 underlying policy limit and the $225,000 underinsured motorist coverage policy limit for the client’s pain and suffering.
